Terms of Service

By accessing or using Kicozy, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service. Creating an account confirms that you accept these Terms.

Kicozy is an online listings platform / marketplace for discovering homes for rent or sale in Rwanda (starting with Kigali) and connecting with brokers. Brokers list properties; seekers browse, see visit fees and commissions where shown, review broker ratings and comments, and contact brokers by phone or WhatsApp.

Kicozy:

• is not a party to rental or sale agreements between users;
• does not guarantee that any listing is available, accurate, or suitable;
• does not provide in-app messaging in the current product;
• does not replace licensed professional advice (legal, valuation, or otherwise).

Kicozy provides tools to publish and discover listings and to contact brokers. Commission, visiting fees, rent, purchase price, deposits, and all lease or sale terms are agreed directly between the broker and the tenant or buyer. Kicozy does not set those commercial terms for your deal, is not a party to that arrangement, and is not liable for disputes, non-payment, misrepresentation, or other claims arising from those direct arrangements between users — to the fullest extent permitted by law.

Any payment you make to a broker (including visit fees or commissions) is between you and that broker unless we clearly state otherwise in a future product update.

You must be at least 18 years old and able to form a binding agreement under applicable law to create an account or use Kicozy for housing-related transactions. Kicozy does not currently verify age at signup; by creating an account or using the service, you confirm that you meet this requirement.

You agree to provide accurate information and to keep your login details confidential. You are responsible for activity under your account. Tell us promptly if you suspect unauthorized use.

We may suspend or close accounts that violate these Terms, appear fraudulent, or create risk for other users or the platform.

If you browse or contact brokers through Kicozy, you agree to:

• use contact details and listing information lawfully and respectfully;
• not harass, spam, scrape, or misuse personal data obtained through the service;
• leave reviews that are honest and not abusive, defamatory, or fake;
• make your own careful checks before paying visit fees, deposits, rent, or purchase money — including verifying the broker and property offline as needed.

If you create a broker account or publish listings, you represent and agree that:

• you are entitled to market the properties you list;
• listing information (including price, fees, commissions, location, availability, photos, and status) is accurate and kept reasonably up to date;
• photos and descriptions are not misleading;
• you will not post unlawful, discriminatory (where prohibited by law), or fraudulent content;
• visit fees and commissions shown match what you actually charge, unless clearly updated;
• you will complete phone verification when required before publishing;
• you are solely responsible for your communications and agreements with seekers outside Kicozy.

You may not:

• violate applicable law;
• infringe others’ intellectual property or privacy rights;
• upload malware or attempt unauthorized access to systems or data;
• manipulate ratings, reviews, or listing visibility unfairly;
• impersonate another person or misrepresent your affiliation;
• use Kicozy to facilitate fraud, scams, or other harmful schemes.

You retain ownership of content you upload (such as listing photos and descriptions). You grant Kicozy a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content as needed to operate, improve, and promote the marketplace.

You are responsible for having the rights needed to upload that content.

Optional Google Sign-In, SMS/OTP delivery via Africa’s Talking (when enabled), and hosting on AWS are provided with or through third parties and may be subject to those providers’ terms. When you call or message a broker on WhatsApp or by phone, those services’ own terms and policies apply. Kicozy is not responsible for third-party platforms you choose to use.

Visit fees, commissions, and prices displayed on listings are provided by brokers for transparency. They do not make Kicozy a party to your transaction. See section 3.

To the fullest extent permitted by law, Kicozy is provided “as is” and “as available.” We do not warrant uninterrupted or error-free operation, or that listings, broker information, or reviews are complete, current, or reliable. You use the service and rely on listing information at your own risk.

To the fullest extent permitted by applicable law, Kicozy (and its operators, employees, and partners) are not liable for:

• indirect, incidental, special, or consequential damages;
• lost profits, lost data, or business interruption;
• losses arising from deals, disputes, payments, visit fees, commissions, leases, or sales between users;
• reliance on listing or broker information;
• downtime, bugs, or security incidents beyond our reasonable control.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the applicable law of Rwanda.

To the extent permitted by law, you agree to indemnify and hold harmless Kicozy from claims, damages, and expenses (including reasonable legal fees) arising from your content, your listings, your use of the service, or your breach of these Terms.

We may update these Terms, or change or discontinue features, as the product evolves. We will post the updated Terms on this page and revise the “Last updated” date. Continued use after changes means you accept the updated Terms, except where applicable law requires a different process.

We may remove content or restrict access when reasonably necessary to protect users, comply with law, or protect the platform.

These Terms are governed by the laws of Rwanda. Subject to any mandatory protections that apply to you, disputes will be resolved in the competent courts of Rwanda.

These Terms may be made available in English and Kinyarwanda. Until a lawyer-approved bilingual version is finalized, the English version will guide interpretation if translations differ — unless applicable law requires otherwise.
